  16.    SEC. 240001. MISSING ALZHEIMER'S DISEASE PATIENT ALERT

  20.    (a) Grant .-The Attorney General shall, subject to the
  21.    appropriations, award a grant to an eligible organization to
  22.    the organization in paying for the costs of planning,
  23.    establishing, and operating a Missing Alzheimer's Disease
  24.    Alert Program, which shall be a locally based, proactive program to
  25.    protect and locate missing patients with Alzheimer's disease and
  26.    related dementias.

  30.    (b) Application .-To be eligible to receive a grant under subsection
  31.    (a), an organization shall submit an application to the Attorney
  32.    General at such time, in such manner, and containing such information
  33.    as the Attorney General may require, including, at a minimum, an
  34.    assurance that the organization will obtain and use assistance from
  35.    private nonprofit organizations to support the program.

  39.    (c) Eligible Organization .-The Attorney General shall award the grant
  40.    described in subsection (a) to a national voluntary organization that
  41.    has a direct link to patients, and families of patients, with
  42.    Alzheimer's disease and related dementias.

  46.    (d) Authorization of Appropriations .-There are authorized to be
  47.    appropriated to carry out this section-

  50.    
  51.    (1) $ 900,000 for fiscal year 1996;
  52.    
  53.    
  54.    
  55.    (2) $ 900,000 for fiscal year 1997; and
  56.    
  57.    
  58.    
  59.    (3) $ 900,000 for fiscal year 1998.

  63.    SEC. 240002. CRIMES AGAINST THE ELDERLY.

  66.    
  67.    (a) In General .-Pursuant to its authority under the Sentencing Reform
  68.    Act of 1984 and section 21 of the Sentencing Act of 1987 (including
  69.    its authority to amend the sentencing guidelines and policy
  70.    statements) and its authority to make such amendments on an emergency
  71.    basis, the United States Sentencing Commission shall ensure that the
  72.    applicable guideline range for a defendant convicted of a crime of
  73.    violence against an elderly victim is sufficiently stringent to deter
  74.    such a crime, to protect the public from additional crimes of such a
  75.    defendant, and to adequately reflect the heinous nature of such an
  76.    offense.

  80.    (b) Criteria .-In carrying out subsection (a), the United States
  81.    Sentencing Commission shall ensure that- [*H8849]

  85.    (1) the guidelines provide for increasingly severe punishment for a
  86.    defendant commensurate with the degree of physical harm caused to the
  87.    elderly victim;
  88.    
  89.    
  90.    
  91.    (2) the guidelines take appropriate account of the vulnerability of
  92.    the victim; and
  93.    
  94.    
  95.    
  96.    (3) the guidelines provide enhanced punishment for a defendant
  97.    convicted of a crime of violence against an elderly victim who has
  98.    previously been convicted of a crime of violence against an elderly
  99.    victim, regardless of whether the conviction occurred in Federal or
  100.    State court.

  104.    (c) Definitions .-In this section-

  108.    "crime of violence" means an offense under section 113, 114, 1111,
  109.    1112, 1113, 1117, 2241, 2242, or 2244 of title 18, United States Code.

  114.    "elderly victim" means a victim who is 65 years of age or older at the
  115.    time of an offense.
